These terms and conditions apply to all competitions listed on the Promoter’s website at www.winwincompetitions.com hereafter defined as the “Website” –
- All Competitions are considered to be skill-based competitions requiring the entrants to exercise thought, knowledge and /or skill to correctly answer the question(s)or task(s) posed by the Promoter in strict accord with the answer held by the Promoter “the correct answer” so as to be afforded the opportunity to win the prize offered. “The correct answer” shall be conclusively considered to be the correct answer as determined by the Promoter, at its sole discretion, for the purposes of the competition). To be afforded with a chance of winning, anyone who enters the competition (an “Entrant”) is required to correctly answer a question or questions or solve a problem or problems set by the Promoter (the “Competition Task”).
1.1.1 Multiple competitions may be operated by the Promoter in parallel (at any one time), each competition will have one specific ‘prize’ which in accord with the terms hereof may be substituted by the Promoter, at its absolute discretion, with an alternative cash prize
1.1(b) As a condition of entering the Competition, Entrants must ensure that, by doing so, they do not contravene any laws of their country of residence.
1.1(c). If an Entrant enters the Competition unlawfully the Promoter will not be liable in any way;
1.1(d) An Entrant shall mean any person who enters any of the Promoter’s competition(s) by any valid means (either by entering directly through the website or via the free entry method).
1.1(e) The Winner shall be the Entrant chosen by random draw before or after the closing date who will be entitled to receive the prize in accordance with these Terms & Conditions.
1.1(f) The Winner must provide Proof of identity prior to presenting in person to claim and collect the prize which must match that of the details provided when entering the respective competition.
1.1(g) Each competition will close once the closing time and date has been reached or the maximum number of entries has been reached for the respective competition. The draw date will be announced within 24 hours of the close of the competition.
1.1(h) At the sole discretion of the promoter, if the number of paid entries at the time of closing the competition does not reach the Maximum Number of Paid Entries, but is nevertheless deemed by the promoter sufficient for the purposes of the competition the prize may still be awarded.
1.1(i) Only completed Entries which contain “the correct answer” (as so defined by the Promoter) will be entered into the Competition. Failure to answer any question correctly via the website will still result in the entrant being charged.
1.2 By entering any of the Promoters competition(s) whether via the website or otherwise the Entrants acknowledge that they shall be deemed to have read, understood, acknowledged and accepted each and all of these Terms and Conditions and further that they agree to be irrevocably bound by them; By entering into the Competition, all Entrants acknowledge that their payment for each entry to answer the Question(s) or Task(s),and thereby enter the Competition, does not guarantee in any way that they will win the prize.
1.3 To qualify as a successful entry into the competition each entry must contain full valid contact details for each Entrant in full accord with the detail requested by the Promoter which shall include (but not limited to) the entrants proper full Christian name and surname, their correct date of birth ( which must evidence they to be over the age of eighteen years as at the time of entry), their principal residential address and a valid e-mail address and phone number of which they are, individually, the sole owner.
1.4 The Entrant through making an entry confirms giving of their explicit and irrevocable consent to the details required to be provided at 1.3 above being retained, accessed and used by the Promoter, at the Promoters sole discretion, for each, any and all of the following purposes;
(a) To contact the Winner and to provide notification that they have won the prize;
(b) For all and any publicity and or compliance purposes.
1.5 All entrants acknowledge that they shall remain at all times solely and entirely responsible for, providing to and maintaining with, the Promoter their current accurate and correct contact details as are required hereunder and shall indemnify entirely The Promoter against any claim or loss arising or attributable to any failure or inability of The Promoter to secure the contact required by the Promoter which is in anyway attributable to any error(s), inaccuracy(ies), misinformation or missing information contained in the required contact details provided with each entry.
1.6 Failure to answer any question correctly via the website will still result in any entrant being charged.
1.7 An entry fee is payable each time an entrant wishes to enter the Promoters competition (save and excepting through a single entry made through the free entry route details of which are set out below at paragraph numbered 3.2). Once the Entry is submitted, the Entrant’s card payment will be electronically approved.
1.8 A successful entry must include the correct answer (as defined at 1.1 above) which must be submitted for each question, along with the Entrants correct details (in accord with 1.3 above) and full payment of any fee due for the specific competition entry. Payment may be made in pounds sterling or euro and can only be made by the entrant at time of submission of the entry.
1.9 An Entrant may make a single free entry, which must contain each and all of the same details as set out above, by the free entry route, details of which are set out below at paragraph numbered 3.2.
1.10 All Entries to the Competition are final and no refunds will be issued at any time or for any reason, except in the case of the Promoter cancelling the competition. Save in the event the Promoter cancels the competition the Promoter will strictly adhere to a No Refund policy and no entrant shall be entitled to a refund at any time save in the event of the cancellation of the competition by the Promoter the entrants are considered solely responsible for any loss of their entry fee, regardless of the circumstances, where same has been paid and it subsequently transpires that for whatever reason the entry is unsuccessful, void or subsequently voided which, by way of example would include the undernoted instances;
- if, having submitted an entry to the competition , you subsequently learn that you are not eligible to enter the competition or claim /receive any Prize;
- if, following your having entered into the competition, the eligibility criteria for entering the competition or claiming / receiving the Prize changes and you then become no longer eligible; or
- if you are disqualified from the competition by the Promoter for any reason at any time whether before or after the conclusion of the competition or before or after the delivery up of any Prize.
2 The competition will run from and including the opening and closing dates specified on the Website. These dates shall be referred to as the “Opening Date” and “Closing Date” respectively. All times and dates referred to are specified as local time in both Dublin (Ireland) and London, (England, United Kingdom).
2.1 In any instance it necessary to do so, the Promoter reserves the right to change the Opening and Closing Dates and in such an instance they change the Opening Date and /or the Closing Date of a competition, the new details will be detailed on the Promoters Website.
2.2 For each of the Promoters competitions, all entries must be received by the Promoter no later than the time and closing date specified in respect the specific competition on the promoters website with the exception of free entries, which must be in the Promoters possession a minimum of 48 hours prior to the Closing Date. All competition entries received after the expiry of the time constraints detailed will be considered as null and void and processed as automatically disqualified and no refunds will be given.
2.3. The Promoter shall have no responsibility nor be liable for any loss suffered by an entrant due to entries that are incomplete or are not successfully submitted, are lost or are delayed regardless of cause, including, without prejudice to the generality of the foregoing and solely by way of example, as a result of any, communications, network, infrastructure, computer, server failure, technical malfunction, systems, satellite, computer hardware or software failure, postal delays or human failure or any other reason howsoever arising.
2.4 A maximum number entries to the competition may be stated on the Website and the number of entries you are able to make may be limited upon the maximum number of entries being reached. Prior to the maximum number of entries (if any) being reached any single entrant may make a maximum of 20 fee paid entries and one free entry (via the free entry route details of which are set out below at paragraph numbered 3.2.
3 By submitting a competition entry (by either purchasing competition entries and / or submitting a free competition entry) you are entering into a contract with the Promoter and are confirming your acceptance of the Promoters Terms and Conditions and agreeing irrevocably to be bound by them. By entering the competition, you agree that, and consent to, your order number, name and entry number(s) will be displayed on our social media platforms and on our website. The process for submitting a competition entry is as follows:
3.1 Entering by Purchase entry route:
In order to enter any of the Promoter’s competitions by purchasing entries you should follow these steps:
- Go to the Website and select the competition you wish to enter to view the Competition Question(s) or Competition Task(s)and our terms and conditions;
- Fully complete and submit the online entry form; then
- Purchase the required number of entries. Payment must be made in Pounds Sterling (GBP) or Euro; then
- When you have purchased your entries, submit your answer to the Competition Question(s) or Task(s)
- Entries are limited to 20 per person per competition (subject to availability).
3.2 Entering by Free entry route:
A free entry route is available for a single entry into any of the Promoter’s competitions by following these steps:
- Go to the Website and select the competition you wish to enter to view the Competition Question(s) or Task(s) and our terms and conditions;
- Complete and send a single postcard (without an envelope), via First Class post to:
Win Win Competitions Ltd, Unit 4 Greenbank Business Centre, Newry, N.Ireland, BT342PF stating the following details in clear, legible and readily decipherable lettering:
- The competition you wish to enter;
- Your full name (Christian and Surname) and your residential postal address;
- Your personal telephone number and personal email address;
- Your correct date of birth;
- Your answer to the Competition Question.
- Please note the following important information regarding free entires:
Free entries are limited to one per person per competition and correctly completed free entries must contain all of the above requested details in clear legible and easily decipherable lettering.
3.2.1 Since the Promoter needs sufficient time to process any free entries to ensure their inclusion on the relevant competition they be delivered to and received by the Promoter at least 48 hours prior to the Closing Date. Any free entries received after this date or any free entries deemed by the Promoter to be illegible or otherwise not to be in full compliance with each and all of the Promoters terms and conditions will not be processed and otherwise correct entries will not considered for entry into the draw.
3.2.3 Any free entries received by the Promoter after the maximum number of entries for the competition has been reached, shall not be processed and accordingly such entries will not be entered into the draw.
3.2.4 The Promoter will treat free entries in an equal manner to paid entries ensuring those who answer the competition question correctly, in full accordance with these terms and conditions, have an equal chance of winning a prize.
4 All Entries, upon receipt, will become the property of the Promoter and will not be returned. The Promoter is under no obligation to confirm whether or not an entry was received prior to the deadline or whether the Entrant’s answer to the Competition Question was correct. The promoter will be required only to notify the successful winning Entrant in accord with these terms and conditions.
4.1 In all respects The Promoter’s decision is final and no correspondence will be entered into about the result of the Competition following the determination of the Winner as described herein.
4.2 It is each individual Entrant’s sole responsibility to ensure that their entry is in full compliance with the Promoters terms and conditions and that it is received by the Promoter in advance of the stated deadline.
4.3 Any free entry not in full compliance with each and all of the entry requirements as published by the Promoter in their terms and conditions for such competition shall be deemed disqualified and not entitled to entry into the draw.
4.4 All entries must be submitted in the English language. Any entry submitted in any other language (not in English) will be automatically disqualified and in no refund given.
4.5 With the exception of free entries, the Promoter will acknowledge receipt of your entry and will confirm if your answer to the Competition Question(s) or Task(s) is correct or not.
- The competition is open to all adult residents in the United Kingdom and Ireland (unless otherwise specified in the competition details) who must be aged 18 years or over at the time of submission of entry, EXCEPT:
- the Promoter
- any employee of the Promoter;
- any Agent, Supplier or Officer of the Promoter, or the employees of agents, suppliers or officers of the Promoter, who are in any way involved in the competition or its administration;
- members of the immediate families or households of (a) and (b) and (c) above.
- By entering the competition, you confirm that you are eligible to do so and that you are eligible to claim any prize you may win.
- The Promoter may, at any time require you to provide proof that you were eligible to enter the competition as at the time of submission of entry. If you fail to provide the Promoter with any such proof or other information that they may require within a reasonable time, you may be disqualified from the competition and will be considered ineligible to receive any benefit there under.
- The Promoter will not accept competition entries that are:
- Incomplete; or
- automatically generated by computer; or
- deemed by the Promoter to be illegible; or
- deemed by the Promoter not to be in full compliance with the Promoters terms and condition for the competition.
- In the event an entrant’s conduct is considered by the promoter to be in conflict with or contrary to the spirit or intention of the prize competition the Promoter reserves all rights to disqualify them
- Entries are limited to a maximum of 20 fee paid entries and / or one free entry per person per individual competition. Entries will be limited if the maximum number of entries for the competition is reached and in such circumstances no further entry shall be accepted although if submitted same shall be deemed invalid and shall not be processed however no refund of any fee submitted shall be made.
- Entry lists will be displayed in each competition page on our website.
CLOSING THE COMPETITION
6 The competition will close when the Maximum Number Of Entries and/or the Closing Date is reached; however should it be deemed appropriate the Promoter reserves the right to extend the closing date by 7 days, up to a maximum of 4 times at their discretion.
6.1 Should the Promoter determine that any competition will conclude early or in the event the number of entries to the Competition does not exceed the maximum number of entries at the closing date, the Competition will either close and the proceeds will either be deemed sufficient to award the prize at the sole discretion of the Promoter, or the remaining funds will be allocated as an alternative cash prize to a winner after the deduction of any transaction and marketing fees.
6.2 The Promoter will be entitled to retain 30% of all Entry Fees to cover administration. The remaining balance of the entry fees taken for that particular competition following deduction of the 30%, plus marketing fees and transaction fees, shall be “the alternative cash prize” which will then be offered to the winning Entrant.
DETERMINING THE WINNING ENTRANT
7 There will only be one winner per competition unless otherwise stated.
7.1 All Entrants who correctly answer the Competition Question(s) or Task (s) AND whose entry (made in full compliance with the Promoter’s Terms and Conditions) is received prior to the Closing Date (or specified earlier deadline in respect of free entries) will be placed into a draw and the winner will be chosen by random draw. The random draw will take place as soon as reasonably practical and, generally, within 7 days of the Closing Date (“Draw Date”). Full details of the draw date/time will be confirmed once the competition has been concluded via our website. This decision will be made within 1 day (24 hours) of the close of the competition.
7.2 To ensure transparency the random draw to determine the winning entrant will be conducted live on Facebook (and / or any other suitable social media platforms).
8 The Promoter shall be the sole owner of any prize offered from the time the competition is live until successful handed over and received by the winning entrant in accord with the Promoter’s Terms and Conditions.
8.1 The prize for the competition will be described on the Promoters Website (the “Prize”). There shall be no cash alternative for the prize save and excepting in the circumstances detailed at paragraphs numbered 6, 6.1 and 6.2 above. The prize is not otherwise negotiable in any respect. All descriptions and details provided of the Prize are provided in good faith to the best of the Promoter’s knowledge, information and belief, and considered by the Promoter as correct as at the Opening Date. The Promoter does not imply or give any warranty or accept any valuation to the Prize nor does the promoter guarantee the roadworthiness in anyway shape or form. The Entrant must form their own thoughts, make their own decision and rely upon their own judgement having had the opportunity to make their own enquiries and seek independent legal advice before entering the Promoter’s competition.
8.2 Prizes shall be subject to availability and the Promoter retains the right and shall be fully entitled to substitute the prize with a prize which the Promoter reasonably considers to be of equal or greater value. When any details of the Prize change, the Promoter shall endeavor to update the Website as soon as reasonably possible.
8.3 The prize will only be that as awarded at the time of the draw, no alternatives will be offered under any circumstance.
8.4 If the contest is completed and the Prize is issued and claimed successfully then the prize will be transferred by the Promoter to the winner of the contest. In the instance the Prize being issued is a motor vehicle then the ownership will be transferred via the V5 for that car. This must be completed before the car ownership is handed over. The winner is responsible for taxing and insuring the vehicle as required and the Promoter will have no responsibility over the Prize(s) once hand over is completed.
8.5 Collection of the prize is the sole responsibility of the winner, from the Promoter’s address (Win Win Competitions Ltd, Unit 4 Greenbank Business Centre, Newry, N.Ireland, BT342PF ) unless otherwise stated on the competition. Delivery of a prize can be arranged for the winner at the winner’s cost.
8.6 The winner will be required to provide proof of identity and proof of entry into the competition at the time that the prize is collected.
8.7 The Promoter shall not be considered to have made any representations nor to have given any warranties in respect the Prize. The information provide on the Website is descriptive only and provided by the Promoter in good faith and is considered by the Promoter to be correct as at the opening date. The Promoter accepts no responsibility for any inaccuracy, omission or error occurring in the Promoters description or detail of the Prize on the Promoters website. Where the Prize is to be supplied by a third party the Promoter will seek to include details of the Supplier where practical on the Promoters Website. The Promoter makes no binding representations and gives no warranties whatsoever about the Prize, its value, its condition or road worthiness as at the time the prize is exchanged or any other information provided on the Website save that the Promoters description on the website was made in good faith at the opening date of the competition.
- The decision of the Promoter is in all respects full and final and the Promoter will be under no obligation whatever to entertain any correspondence or discussion on the matter or at all.
9.1 The Promoter will seek to contact the winner personally, in accord with the details contained within the valid entry which has been successfully selected in the random draw, as soon as practicable after the Draw Date. In making contact the promoter shall be entitled to rely upon the telephone number or email address provided with the competition entry.
If for any reason the Winner cannot be contacted by the Promoter within 7 days of being notified of their status as the Winner by e-mail, telephone, Facebook or mail via the contact details submitted along with their entry, then the Promoter reserves the right to then select an Alternate winner, who will then have 7 days to accept the prize following the same routes of contact as the original Winner. The original winner will have no claim to the prize after the Alternate Winner is selected. In respect of each and every entrant selected consecutively as winner the precisely same terms and conditions apply until the prize has been successfully awarded and claimed.
9.2 In the event your personal details, including contact information, changes at any time you must notify the Promoter as soon as reasonably possible and in any event within two normal working days of the Closing date. Notifications should be sent to the Promoter via email to [email protected] Notifications must include details of the competition you have entered, the details you previously provided and the new details which you seek to update. Where notification of change of details is received by the Promoter within two working days of the closing date, the Promoter will use your old details should the promoter have reason to try to contact you.
9.3 The Promoter is obliged to publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will disclose the surname and County of residence of the major prize winners to anyone who writes to the promoter at Win Win Competitions Ltd, Unit 4 Greenbank Business Centre, Newry, N.Ireland, BT342PF (enclosing a self-addressed envelope) not later than one month after the Closing Date of the competition. If you would intend to object to your surname and county being published or made available, please contact the Promoter at winwincompetitions.com prior to the Closing Date. The Promoter remains legally obliged to provide the information to the Advertising Standards Authority if requested. In addition in making entry the entrant has accepted the promoters terms and condition which include the Entrant giving irrevocable consent to the Promoter for use of the personal detail of winners, including photographs and video imagery, in publicity purposes both in respect the prize won and for the purpose of future advertising of the Promoters competitions.
10.1 A successful entrant must present themselves in person to the Promoter or the Promoters Agent or nominee to claim the Prize in person. The Prize is not transferable in any respect and may not be claimed by any third party on an entrants behalf. Details of how the Prize will be made available for collection will be provided to the successful entrant directly by the Promoter in the event they have not been published on the Website.
10.2 The Promoter will accept no responsibility for and will not be liable in any respect in the event you are unable to or for any reason whatever fail to take up your prize.
10.3 The Promoter will not have any liability whatever for the successful entrant failing to take up a prize regardless of the circumstances occurring as result in such failure.
LIMITATION OF LIABILITY
- Your statutory rights are not affected. Insofar as is permitted by law, the Promoter, its servants, agents or distributors will not in any circumstances be held responsible for or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize or failure to take up the prize except where it is established as being wholly caused by the negligence of the Promoter, its servants, agents or distributors or that of their employees.
11.1 The Promoter shall not be liable for any loss suffered by an Entrant as a result of incomplete entries or failed computer communications or for any loss suffered as a result of use of the Website.
11.2 The Promoter shall have no responsibility nor be liable for any loss suffered by an entrant due to entries that are incomplete or are not successfully submitted, are lost or are delayed regardless of cause, including, without prejudice to the generality of the foregoing and solely by way of example, as a result of any, communications, network, infrastructure, computer, server failure, technical malfunction, systems, satellite, computer hardware or software failure, postal delays or human failure or any other reason howsoever arising.
- Each Entrant and the Promoter agree that the Promoter may use contact details and other data including personal data (as defined by the Data Protection Act and any current amendments thereto) supplied by the Entrants to the Promoter to administer the Promoters Website and conduct the Competition according to these Terms and Conditions. In addition the Entrants and the Promoter recognise that the Promoter may (either by choice or at the lawful request of a third party) require to disclose this information to relevant third parties for the purposes of the prevention of fraud, money laundering, legal or other financial or regulatory reasons.
12.2 Upon becoming the winner of the competition, the Entrant must present in person to claim the prize as directed by the Promoter and the Promoter has each Entrants irrevocable consent to use their name, image and town or county of residence to announce the winner of this competition. Each Entrant if proceeding to be selected as Winner has agreed, by virtue of making their competition entry, to be available for and to freely participate in any reasonable publicity required by the Promoter to include photographs and or video recordings taken and utilised for promotional purposes, both directly after the win and in any future promotional material.
12.3 Under data protection laws you are entitled to request that the Promoter does not contact you and removes your details from its database. If you make such a request you will deemed to be withdrawing from the competition as it will not be possible to contact you in the event that you are the winner. You will not be entitled to any refund of any entry fee if you are deemed to have withdrawn from the competition. If you do not wish any of your personal details to be used by the Promoter for promotional purposes, please email the Promoter at [email protected] before the Closing Date.
12.4 If you do not agree to participate in any publicity about the competition the Promoter will still provide your details to the Advertising Standards Authority. This is a legal requirement that must be complied with to assist in proving that the competition has been properly administered and the Prize awarded.
12.4 The winner of the competition, will be required to provide validation of their personal information and proof of their identity in order to confirm their eligibility and entitlement to claim the Prize and have ownership of the Prize transferred to them. The Winner is entitled to request further details about how their personal information is being used and may withdraw consent to their personal information being used in such way but by doing so the entrant may prevent the Prize being transferred to them. By submitting an entry the entrant is deemed to having consented to the use of their information in this way and where same is withdrawn after entry the entrant will be deemed to have withdrawn from the competition and to have forfeited the Prize or any actual or potential claim thereto, nor will the entrant be entitled to any refund of any entry fee. In such circumstances the Promoter reserves the right to offer the Prize to the next eligible Entrant selected from the correct entries that were received before the Closing Date.
- The Promoter reserves the right to amend these Terms and Conditions from time to time. The latest version of these Terms and Conditions will be available on the Website. These terms and conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales. The Entrants and the Promoter recognise that the Competition, its administration and all associated activities are governed by English Law and the Promoter and Entrants recognise that the County or High Courts of England and Wales shall have exclusive jurisdiction in the event of any dispute arising out of the Competition or its administration;
13.1 The Promoter wholly reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
13.2 Where the Promoter considers there is or may be any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude any entrant from participating in the competition and any future competitions. No refund shall fall due.
13.3 These competition rules shall not create or be construed as creating any form of contract, joint venture or other agreement between any Entrant and the Promoter.
13.4 An entry shall be declared void (without any refund being given) if the entrant engages in: (a) any form of fraud (actual or apparent); (b) fraudulent misrepresentation; (c) fraudulent concealment; (d) hacking or interference with the proper functioning of the website; or (e) amending, or unauthorised use of, any of the code that constitutes the Promoters Website
13.5 Each Entrant agrees that the usual requirement under the Consumer Protection (Distance Selling) Regulations 2000 for any goods and services ordered online to be supplied within 30 days will not apply to this Prize Competition.
13.6 The Promoter reserves the right to cancel the Competition at any time either before or after tickets have been sold. If the Competition is cancelled, the Promoter will return any Entry Fees paid to each Entrant (either by bank card refund or by cheque and in one combined payment where several entries have been made by a competitor or store credit). Where the Entry Fee is returned, the Promoter shall have no further liability to the Entrant or to any other person.
